Terms of Service
Effective: May 12, 2026
1. Acceptance of Terms
By creating a CoTrackPro account, completing a checkout, or otherwise using the Service, you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, do not use the Service.
2. Description of the Service
CoTrackPro is a documentation, communication, and organizational platform for parents and professionals navigating high-conflict family situations, operated by CoTrackPro, LLC. The Service is organized into modules, made available based on your subscription tier:
- Bridges — incident logging, communication rewriting, structured event records.
- Mental — personal safety planning, mood and symptom tracking, and a private space for notes about providers, treatment, and complaints. Stored with additional safeguards described in our Privacy Policy §10.
- Legal — attorney-focused tools for client intake, case checklists, and drafting structure (available on Professional plans only).
- Library — a curated content library with semantic search, bookmarks, and quizzes.
- AI-assisted features — title cleanup, summaries, role recommendations, message rewriting, and semantic search, powered by the AI providers listed in our Subprocessors page and governed by §8 below.
The Service is not a substitute for an attorney, therapist, mediator, or law enforcement. Nothing produced by the Service constitutes legal, medical, or psychological advice.
3. Eligibility
You must be at least 18 years old to create an account. You may not use the Service on behalf of another adult without their consent, and you may not use the Service to track or surveil a minor unless you are their legal guardian or have a court order granting you that authority.
4. Account & Security
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us at admin@cotrackpro.com immediately if you suspect unauthorized access.
5. Subscription, Billing, and Refunds
- Subscriptions are billed by Stripe, Inc. on the cadence shown at checkout (monthly or annual).
- A 14-day free trial may be offered at sign-up. The trial requires a valid payment method, and the subscription will automatically begin at the end of the trial unless you cancel before the trial ends.
- Subscriptions renew automatically until cancelled. You can cancel anytime from your billing page; cancellation stops future renewals and preserves access through the end of the current billing period.
- All fees are non-refundable. We do not provide pro-rated refunds for unused time after cancellation, mid-period cancellations, or unused features.
- Complimentary or promotional access granted by CoTrackPro is provided at our sole discretion and may be modified or revoked at any time.
6. Your Content
You retain all rights to the incidents, messages, documents, and other content you create or upload to the Service (“Your Content”). You grant CoTrackPro a limited, non-exclusive, royalty-free license to host, process, transmit, and back up Your Content solely to provide the Service to you.
You may export Your Content at any time. Upon account deletion, Your Content is removed from active systems within 30 days, subject to backup retention and legal hold obligations described in §15.
7. Acceptable Use
You agree not to use the Service to:
- Harass, intimidate, stalk, defame, or threaten any person.
- Fabricate, alter, or backdate records, or otherwise create false evidence.
- Record audio, video, or communications in violation of applicable consent laws (including two-party consent jurisdictions).
- Disclose information that you are bound by court order, settlement, or non-disclosure agreement to keep confidential.
- Reverse-engineer, scrape, or use automated systems to interact with the Service except via our published APIs.
- Attempt to gain unauthorized access to other users' accounts or to CoTrackPro infrastructure.
We may suspend or terminate any account that, in our reasonable judgment, violates these rules. The fact that the Service helps you document a high-conflict situation does not mean it can be used to escalate or perpetuate one.
8. AI-Assisted Features & Responsible Use
CoTrackPro uses third-party AI providers — currently Anthropic Claude, Amazon Web Services Bedrock (Titan v2 embeddings), and optionally OpenAI — to power message rewriting, summaries, role recommendations, and semantic search. Our governance commitments:
- No model training on your data. Our AI providers contractually commit not to retain or train on data sent through their commercial APIs, and we do not opt into any training programs.
- Probabilistic output. AI-generated content can be inaccurate, incomplete, or biased. You are solely responsible for reviewing AI output before relying on it, sending it to another party, or filing it in a legal proceeding.
- No autonomous actions. AI features in CoTrackPro produce text and recommendations only; they do not autonomously take account, billing, or external-communication actions on your behalf.
- Sensitive third-party information. Do not enter information about non-consenting third parties — including a co-parent's medical, financial, or location data — that you are not legally authorized to process.
- Provider transparency. The current list of AI providers and the features each one supports is maintained on our Subprocessors page; material changes are announced before they take effect.
9. Intellectual Property
The CoTrackPro name, logo, website, code, content library, AI prompts, and underlying technology are owned by CoTrackPro, LLC. and protected by U.S. and international intellectual property laws. We grant you a personal, non-transferable, revocable license to use the Service for its intended purpose during your active subscription. Nothing in these Terms transfers ownership of CoTrackPro intellectual property to you.
10. Privacy
Our handling of your personal data and Your Content is governed by our Privacy Policy, which is incorporated into these Terms by reference.
11. Subprocessors
We rely on a limited set of vetted infrastructure and AI vendors to operate the Service. The current list is maintained on our Subprocessors page, which we update independently of these Terms whenever a vendor is added, removed, or substantially changes role. By using the Service, you authorize the routing of necessary data to those subprocessors strictly for the purposes of providing the Service.
12. Standards & Compliance
We aim to meet recognized standards for handling personal data, payment information, and email communications. Concretely:
- Payments: processed by Stripe under PCI-DSS Level 1. We never receive or store card numbers, CVCs, or bank account credentials.
- Authentication: handled by Clerk, which maintains SOC 2 Type II certification.
- Infrastructure: hosted on Amazon Web Services (SOC 1/2/3, ISO 27001, HIPAA-eligible) and Vercel (SOC 2). Our use of these platforms does not, by itself, make CoTrackPro certified under those frameworks.
- Email: all non-transactional email includes a one-click unsubscribe link with HMAC-SHA256 tokens, meeting CAN-SPAM Act and RFC 8058 requirements.
- Privacy rights: we honor GDPR access, erasure, portability, and consent-withdrawal rights, and CCPA/CPRA access and deletion rights, as described in our Privacy Policy §12.
Important limits.CoTrackPro itself is not currently SOC 2, HIPAA, or PCI-DSS certified as a covered entity. We are not a health plan, healthcare provider, or healthcare clearinghouse under HIPAA, and we do not currently sign Business Associate Agreements. Statements above describe our subprocessors' certifications and our own engineering practices — not a personal certification of CoTrackPro, LLC.
13. Service Updates, Bug Reports & Continuous Improvement
We make a continuing commitment to keep the Service accurate, reliable, and current:
- Bug reports. If you find a tool, page, or piece of content that is inaccurate, misleading, or broken, email admin@cotrackpro.com with the subject line “Bug Report” or “Inaccuracy Report.” We will acknowledge within three business days.
- Security disclosure. Suspected security issues should be sent to the same address with “Security Disclosure” in the subject. We will not pursue legal action against good-faith researchers who give us a reasonable window to fix an issue before public disclosure.
- Material change notice. When we add, remove, or substantially change an AI provider, subprocessor, or feature in a way that affects how your data is processed, we will update /subprocessors and, where the change is material to privacy, our Privacy Policy. Active subscribers are notified by email of material changes.
- Service availability. The Service is provided on a best-effort basis; we do not offer a contractual uptime SLA. We will, however, communicate openly during major outages and post-mortem material incidents on request.
14. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF AI-GENERATED CONTENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT YOUR CONTENT WILL BE ADMISSIBLE OR PERSUASIVE IN ANY LEGAL PROCEEDING.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COTRACKPRO, LLC. AND ITS OFFICERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, GOODWILL, OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS IS LIMITED TO THE AMOUNT YOU PAID COTRACKPRO IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS (USD $100), WHICHEVER IS GREATER.
16. Indemnification
You agree to indemnify and hold harmless CoTrackPro, LLC. from any claim, loss, or expense (including reasonable attorneys' fees) arising out of (a) your use of the Service, (b) Your Content, (c) your violation of these Terms, or (d) your violation of any applicable law or the rights of a third party — including any co-parent, ex-partner, family member, or counsel adverse to you.
17. Termination
You may stop using the Service at any time by cancelling your subscription from the billing page and deleting your account by emailing admin@cotrackpro.com.
We may suspend or terminate your access immediately, without notice, if you breach these Terms, if continued service exposes us to legal liability, or if your account becomes the subject of a court order, subpoena, or law-enforcement request that limits our ability to provide the Service.
18. Legal Process and Data Retention
We may retain Your Content beyond account deletion when required to comply with a subpoena, court order, or other valid legal process. We will give you notice of any legal request for Your Content where we are legally permitted to do so. Backups containing residual data may persist for up to 90 days after deletion for disaster-recovery purposes.
19. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify active subscribers by email and update the “Effective” date below. Continued use of the Service after a change constitutes acceptance of the updated Terms. If you do not agree to a change, cancel your subscription before the change takes effect.
20. Governing Law and Disputes
These Terms are governed by the laws of the State of Missouri, U.S.A., without regard to its conflict-of-law principles. You and CoTrackPro, LLC. agree to the exclusive jurisdiction of the state and federal courts located in Missouri for any dispute arising out of these Terms, except where prohibited by mandatory consumer-protection law in your jurisdiction.
21. Miscellaneous
- Severability. If any provision of these Terms is held unenforceable, the remaining provisions remain in effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
- No waiver. Our failure to enforce a provision is not a waiver of our right to do so later. No waiver of any term is effective unless given in writing by an authorized representative of CoTrackPro, LLC.
- Assignment. You may not assign or transfer these Terms or any rights under them without our prior written consent. We may assign these Terms without restriction, including in connection with a merger, acquisition, reorganization, or sale of assets.
- Entire agreement. These Terms, together with our Privacy Policy and Subprocessors page, constitute the entire agreement between you and CoTrackPro, LLC. regarding the Service and supersede any prior agreements or understandings on the subject.
- Survival. Sections that by their nature should survive termination — including Your Content (§6), Intellectual Property (§9), Disclaimers (§14), Limitation of Liability (§15), Indemnification (§16), Legal Process and Data Retention (§18), and Governing Law and Disputes (§20) — survive any termination or expiration of these Terms.
- Force majeure. We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, war, terrorism, riots, civil unrest, government action, labor disputes, pandemics, power or telecommunications failures, or unavailability of upstream infrastructure (such as our hosting, payment, authentication, or AI providers).
- Notices. We send legal and account notices to the email address on your account; please keep it current. You may send notices to us by email at admin@cotrackpro.com. Notices are effective when sent.
- Electronic communications. By creating an account, you consent to receive electronic communications from us (email, in-product notifications) and agree that any agreement, notice, disclosure, or other communication delivered electronically satisfies any legal requirement that it be in writing.
- Headings. Section headings are for convenience only and do not affect interpretation.
